Rav Moshe Taragin Shiur#08: The Nature of Nezirut Talmudic Methodology
Rav Moshe Taragin The Personal Transformation of a Nazir Several gemaras reinforce a fundamental difference between a neder and a shevu’a. (See for example Nedarim 2b and Nedarim 13b). Both belong to the general category of hafla'ah, empowering a person to create halakhic change through verbal declaration; while a neder alters the halakhic status of a particular item (issur cheftza), a shevu’a, at most, creates a personal obligation to execute or avoid certain actions (issur gavra). Rav Moshe Taragin Who is Obligated in the Mitzva of Chinukh? Although a katan is exempt from mitzvot, the Rabbanan instituted a mitzva to train him in mitzva performance, the mitzva of chinukh. Did the Chakhamim obligate the minor DIRECTLY, so that the father merely facilitates his son's obligation? Or did the Chakhamim impose the mitzva upon the father, perhaps as a component of the father's own mitzva fulfillment? In this shiur, we will consider a number of nafka minot of this question.
